1. Acceptance of Terms
Welcome to Vortex VR. These Terms of Use ("Terms") govern your access to and use of the Vortex VR website (the "Site"), our online booking services, and your participation in any virtual reality experiences, events, or other services provided at our physical location (the "Venue"). By accessing the Site, making a booking, or entering the Venue, you, your heirs, and assigns (collectively, "you" or "your") agree to be legally bound by these Terms, our Privacy Policy, and all other applicable policies, all of which are incorporated by reference. You also agree to comply with all applicable local, state, national, and international laws and regulations. If you do not agree with any part of these Terms, you are strictly prohibited from using our Site and services and must immediately cease all use and exit the Venue.
2. Eligibility and Health & Safety Acknowledgment
You must be at least 8 years of age to participate in our VR experiences. Participants under the age of 18 must have a parent or legal guardian agree to these Terms on their behalf. You acknowledge that virtual reality experiences can be intense and may cause motion sickness, dizziness, disorientation, eye strain, or other physical or psychological effects. You represent that you are in good physical and mental health and are not under the influence of drugs or alcohol. Individuals who are pregnant, have heart conditions, suffer from epilepsy or seizures, have pre-existing serious medical conditions, or are prone to motion sickness should consult a physician before participating. You agree to participate at your own risk and to immediately notify a staff member if you feel unwell at any point during your experience.
3. Rules of Conduct and Equipment Use
To ensure a safe and enjoyable experience for everyone, all visitors must adhere to the following rules:
- Follow Staff Instructions: You must comply with all verbal and written instructions provided by Vortex VR staff at all times. Failure to do so may result in the immediate termination of your session without a refund.
- Proper Use of Equipment: You are responsible for using the VR equipment, including headsets, controllers, and any other accessories, in a careful and proper manner as instructed. You agree not to tamper with, modify, or attempt to repair any equipment.
- Respectful Behavior: You must behave in a respectful and appropriate manner towards other guests and staff. Any form of harassment, aggressive behavior, or disruptive conduct is strictly prohibited.
- Damage to Equipment: You are financially responsible for any damage to Vortex VR equipment caused by your negligence, misuse, or intentional misconduct. In the event of such damage, you agree to pay a fee equivalent to the full cost of repair or replacement of the damaged item(s), as determined by Vortex VR management.
- Personal Belongings: Vortex VR is not responsible for the loss, theft, or damage of any personal belongings brought into the Venue. We recommend you secure your valuables and avoid bringing unnecessary items into the play area.
4. Bookings, Payments, and Cancellations
All bookings are subject to availability. Payment must be made in full at the time of booking to secure your session. Our policies regarding cancellations, rescheduling, and refunds are detailed in our official Refund Policy, which is incorporated into these Terms by reference. It is your responsibility to review and understand the Refund Policy before making a booking.
5. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Vortex VR or its content suppliers and is protected by international copyright laws. The trademarks, logos, and service marks displayed on the Site are the registered and unregistered marks of Vortex VR. The games and software experiences provided at the Venue are the intellectual property of their respective creators and are licensed to Vortex VR for commercial use. You agree not to copy, reproduce, modify, distribute, or create derivative works from any content on the Site or provided at the Venue without our express written permission.
6. Disclaimer of Warranties and Limitation of Liability
The site and all services, equipment, and experiences at the venue are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Vortex VR disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Vortex VR, its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any personal injury, property damage, or other harm resulting from your participation in VR experiences; (c) any unauthorized access to or use of our servers and/or any and all personal information stored therein. Your participation is voluntary and at your own sole risk.
7. Indemnification
You agree to defend, indemnify, and hold harmless Vortex VR and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Venue is located, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in that jurisdiction.
9. Modifications to Terms
Vortex VR reserves the right, at our sole discretion, to modify or replace these Terms at any time without prior notice. The "Last updated" date at the top of this page will indicate the latest revision. By continuing to access our Site or use our services after those revisions become effective, you agree to be bound by the revised terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the new terms, you are no longer authorized to use the Service.
